Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Swiftkay platform, website, and services (collectively, the "Service"). By creating an account, making a booking, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Swiftkay connects customers ("Clients") with independent professional cleaners ("Cleaners") for residential, short-term rental, and commercial cleaning services. Swiftkay is a platform provider — it is not a cleaning company and does not employ Cleaners directly.
1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By using Swiftkay, you represent and warrant that you meet these requirements. The Service is currently available only to users located in the state of Florida, United States.
2. Accounts
To book a cleaning or apply as a Cleaner, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@swiftkay.com if you suspect unauthorized access.
We reserve the right to suspend or terminate your account if you violate these Terms, provide false information, or engage in fraudulent or abusive behavior.
3. Booking and Service
Making a booking: When you submit a booking, you are requesting a cleaning service at the address, date, and time you specify. Bookings are subject to Cleaner availability and are confirmed upon successful payment processing.
Access requirements: You agree to provide safe and reasonably unobstructed access to the service location at the scheduled time. Failure to provide access may result in a cancellation fee as described in Section 5.
Safe environment: You agree that the property is free from conditions that would pose a health or safety risk to the assigned Cleaner. Swiftkay reserves the right to instruct Cleaners to leave unsafe premises without penalty.
Accuracy of information: You are responsible for providing accurate address, contact, and scheduling information. Swiftkay is not liable for service failures resulting from incorrect information provided by you.
4. Pricing and Payment
First-clean vouchers: Swiftkay offers discounted first-clean vouchers to new Clients. Voucher pricing is subject to availability and applies only to a Client's first booking. Voucher terms, including pricing and hours, are displayed at checkout and may change over time.
Membership: After your first clean, recurring bookings are governed by a membership subscription billed monthly at the rate displayed at checkout. Membership fees are non-refundable except as required by law. You may cancel your membership at any time through your account dashboard, effective at the end of the current billing period.
Payment processing: All payments are processed by Stripe. By providing payment information, you authorize Swiftkay and Stripe to charge the applicable fees. You represent that you are authorized to use the payment method provided.
Failed payments: If a payment fails, we will notify you and may suspend your ability to book new services until payment is resolved.
5. Cancellations and Refunds
Client cancellations: You may cancel a scheduled booking up to 24 hours before the scheduled start time without penalty. Cancellations made within 24 hours of the scheduled start time may result in a cancellation fee of up to 50% of the booking total.
No-shows: If a Client is unreachable or fails to provide access at the scheduled time, the booking is treated as a late cancellation and the full booking amount may be charged.
Swiftkay cancellations: In the event that Swiftkay or a Cleaner must cancel a confirmed booking, we will notify you as early as possible and offer a full refund or priority rescheduling at no additional cost.
First-clean voucher refunds: Unused first-clean voucher amounts are fully refundable within 30 days of purchase, provided no cleaning service has been rendered.
Service dissatisfaction: If you are not satisfied with the quality of a completed clean, please contact us within 24 hours of service completion. We will work with you to assess the issue and, at our discretion, offer a re-clean, partial credit, or refund.
6. Cleaner Terms
Cleaners using the Swiftkay platform to find and fulfill jobs agree to the following in addition to all other Terms:
- Cleaners are independent contractors, not employees of Swiftkay. Cleaners are responsible for their own taxes, insurance, and compliance with applicable law.
- Cleaners must accurately represent their experience and availability during the application process.
- Cleaners must treat Client properties with care and respect. Damage caused by Cleaner negligence is the Cleaner's responsibility.
- Cleaners may not solicit Clients off-platform or enter into private arrangements for services introduced through Swiftkay.
- Cleaner payouts are processed according to the payout schedule communicated at onboarding. Swiftkay reserves its platform fee from each transaction.
7. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Provide false, misleading, or fraudulent information in any booking or application.
- Harass, threaten, or abuse Cleaners, Clients, or Swiftkay staff.
- Attempt to circumvent Swiftkay's platform fees by arranging off-platform payments.
- Reverse-engineer, scrape, or otherwise misuse the Service or its data.
- Upload or transmit malware, viruses, or malicious code.
8. Intellectual Property
All content, branding, software, and materials on the Swiftkay platform — including the name, logo, design, and code — are owned by or licensed to Swiftkay and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SWIFTKAY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. SWIFTKAY DOES NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY CLEANERS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWIFTKAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. SWIFTKAY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SWIFTKAY IN THE 90 DAYS PRECEDING THE CLAIM OR (B) $100.
11. Indemnification
You agree to indemnify, defend, and hold harmless Swiftkay and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall first be subject to informal resolution by contacting us at legal@swiftkay.com. If informal resolution is unsuccessful within 30 days, disputes shall be resolved through binding arbitration in Florida under the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits or class-wide arbitration.
13. Changes to These Terms
We reserve the right to update these Terms at any time. When we make material changes, we will update the effective date at the top of this page. For significant changes, we will provide notice via email or in-app notification at least 7 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
14. Termination
You may stop using the Service and close your account at any time. Swiftkay reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination, all licenses granted to you under these Terms immediately terminate, and Sections 8–14 survive.
